These Terms of Use (“Terms”) govern your access to and use of the website and services provided by Synergy Companies Outreach (“Synergy,” “we,” “our,” or “us”). By using our site or services, you agree to these Terms.

1. Services

Synergy provides professional outreach services via text, email, and phone designed to help businesses start and manage customer conversations. Specific scopes, deliverables, and pricing may be set forth in an order form, statement of work, or similar agreement.

2. Acceptable Use

  • Do not use the services for unlawful, harmful, misleading, or abusive activity.
  • You are responsible for ensuring you have appropriate consent from your contacts for any outreach you request us to perform.
  • You must comply with all applicable communications, privacy, and marketing laws and regulations.

3. Your Content & Licenses

You grant Synergy a limited right to use content and contact lists you provide solely to deliver the services to you and to maintain required records. You represent that you have all necessary rights and permissions to provide such content and contact details.

4. Accounts & Security

You are responsible for maintaining the confidentiality of any login credentials associated with the services and for all activities under your account.

5. Disclaimers

Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific results, open rates, reply rates, or conversions.

6. Limitation of Liability

To the fullest extent permitted by law, Synergy shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, even if we have been advised of the possibility. Our total liability for any claim relating to the services will not exceed the amounts you paid to us for the services giving rise to the claim in the 3 months preceding the claim.

7. Indemnification

You agree to defend, indemnify, and hold harmless Synergy from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your content, your use of the services, or your violation of these Terms or applicable law.

8. Termination

We may suspend or terminate access to the services if we believe you have violated these Terms or applicable law. You may stop using the services at any time.

9. SMS Terms (Program Rules)

  • Program description: With your consent, we may send texts related to service updates, scheduling, reminders, or outreach activities.
  • Opt-in: You must provide your mobile number and agree to receive texts. Consent is not a condition of purchase.
  • Frequency: Message frequency varies.
  • Charges: Message and data rates may apply.
  • Opt-out: Reply STOP to end messages at any time. You will receive a final confirmation message.
  • Help: Reply HELP for assistance or contact us at anna@synergycompaniesoutreach.com.
  • Eligibility: Must be 18 or older to subscribe.
  • Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.
  • Privacy: See our Privacy Policy for how we handle information in connection with the SMS program.

10. Changes

We may update these Terms by posting a revised version with an updated “Effective” date. Continued use of the site or services after changes means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles.
